Affiliate Program: Terms and Conditions

This term and condition is effective between Yves Rocher (Thailand) Co., Ltd. (the "Company") and an individual who joins the Company’s Affiliate Program (the “Affiliate”). By joining the program, you acknowledge that you have read, understood, and agree to all the terms and conditions set forth below.

1. Program Participation

   1. Program Channels: The Company allows individuals to join its Affiliate Program free of charge through various marketplace channels, including TikTok, Shopee, Lazada, and/or any other channels announced by the Company.

   2. Qualifications: Individuals interested in joining the program must have an active online channel, such as a blog, social media page, or any other social platforms suitable for promoting the Company's products. The content on these channels must not contain anything that violates public order or morals, such as gambling or nudity.

   3. Rights and Duties: Participation as an Affiliate does not create an employer-employee relationship with the Company.

2. Affiliate Rights and Responsibilities

   1. Product Promotion: Affiliates must promote the Company's products honestly and accurately, using only the designated Affiliate links provided by the marketplace to ensure proper sales tracking.

   2. Content Creation: Affiliates may create their own content to promote products, such as reviews, articles, or videos. This content must be accurate, not misleading, and must not make exaggerated claims. It must not infringe on the intellectual property rights of others and must not violate public order or morals. The Company is not responsible for any damages incurred from content creation and is not liable for any damages to third parties resulting from the use of inaccurate content.

   3. Affiliates may only use the logos and product images provided by the Company for the sole purpose of product promotion. Modification of these assets or their use for any other unrelated purposes is strictly prohibited.

   4. Restrictions: Affiliates must not engage in illegal or unethical advertising practices, such as spam, using bots, or deceiving consumers.

3. Commissions and Payments

   1. Commission Rate: Affiliates will receive a commission at a rate determined by the Company, calculated based on the net sales generated through valid Affiliate links and valid content. The commission rate may vary depending on specific campaigns and the marketplace you select. You are responsible to read the commission details provided by the marketplace you join.

4. Termination of Agreement

   1. Immediate Termination: The Company reserves the right to immediately terminate an Affiliate's participation without prior notice if the Affiliate is found to be in breach of these terms and conditions, engages in actions that damage the Company's reputation, or uses fraudulent methods to generate sales. The Company's decision in such cases is final.

5. Data Protection

   1. Privacy: Personal data provided by the Affiliate will be used solely for the administration of this program. The Company will maintain the confidentiality of this data in accordance with the Personal Data Protection Act B.E. 2562 (2019) or other relevant laws.

   2. Confidentiality: Affiliates agree not to disclose any confidential information of the Company obtained during their participation in the program to any third party. Any breach of this clause will result in the immediate suspension of the Affiliate’s rights and forfeiture of any accrued commissions.
